Terms and Conditions
Confirmation of a booking and payment of a deposit means acceptance of the contract, which sets out the terms and conditions upon which Scarlet Woods ABN 93 554 151 553, will provide accommodation to you. By accepting this document, you agree to all of the below requirements.
Payment for Accommodation:
- 50% of full amount is payable on booking.
- 50% is payable on the day before arrival.
- Payment on booking; the reservation will not be confirmed by Scarlet Woods until 50% deposit payment is received and cleared.
- Final Payment; the full amount payable from the booking shall be paid on the day before arrival. If the full payment has not been received by Scarlet Woods, then Scarlet Woods reserve the right to cancel the booking with notice and the Guest will forfeit the Guest’s 50% deposit which will be non-refundable in such circumstances.
- If a reservation is made with us directly but no payment is given, the booking rates may increase over this time. You will be liable to be charged the current booking rate, not the original rate at time of reservation.
Cancellations
- If cancelling prior to 14 days before arrival; a refund will be given minus a $50 administration fee, or the full amount paid can be placed in credit for future use with no cancellation fee.
- If cancelling within 14 days of arrival; 50% of full amount is charged.
- There will be no refund in the event of a no-show, or if cancellation happens after the full amount has been charged (the day before arrival).
Amendments to Bookings;
- If amending booking prior to 14 days before arrival; a $50 administration fee may be charged at the discretion of the manager.
- If amending booking within 14 days of arrival; it is deemed as a cancellation and the above cancellation fees are applied.
Booking Extensions
Please let us know ASAP if you would like to extend your stay, it is subject to availability, and you will be charged prior to extended nights.
Method of Payment
We accept the following methods of payment, Mastercard, Visa, Bank transfer (bank details available on request), Cash (at manager's discretion).
Scarlet Woods recommends that the Guest takes out comprehensive holiday cancellation and protection insurance with a reputable insurance company to cater for any unforeseen circumstances which may arise including accident, ill health or any other matters beyond the Guest’s reasonable control.
Events / Functions / Retreats
Shire regulations allow holiday homes to be rented for short-term holiday accommodation purposes only and not for commercial purposes or as a function venue eg: wedding, retreat or party. Functions and gatherings are strictly not permitted and, if evidenced, may be closed down immediately and additional charges will result.
Occupancy
The standard number of people permitted to occupy each chalet is 4. On request with an additional linen fee, we can set up a fold-out bed for a maximum of 2 additional people. Camper vans and roof top tents etc. are not allowed on site. If the number of people is exceeded, we reserve the rate to charge additional guests the full booking fee, or they will have to vacate the property. Scarlet Woods reserves the right to revoke or refuse to honour any property accommodation booking which may in the opinion of either party (and at their sole discretion) be unsuitable for the Property concerned.
Arrivals and Departures
Guests can check in to their chalet from 2pm on the day of arrival. On arrival you will be asked to check the accommodation and accept your stay. Check out is 10am on the day of departure. Please note you will be charged for checking out late, or checking in early, unless previously arranged with Scarlet Woods. Key collection details will be sent prior to arrival and will not be released until this contract has been signed. Early departures will be charged the full amount for their stay. No-shows will also be charged the full amount for their stay.
Duty of Care/ Responsibility/ Property Care
It is the responsibility of the guest to ensure they are respectful to other guests and respect their privacy. Guests must also ensure noise levels are restricted in addition, guests have a responsibility to ensure damage is not deliberately inflicted on the property or its contents. Emphasis must be put on respecting the wildlife, not littering, and the danger of bushfires.
Guest’s Obligations in Respect of the Property
The Guest shall be responsible for the Property during the Guest’s stay. The Guest shall take all reasonable care of the Property and at the end of the stay shall leave the Property including hot tubs, all utensils, fixtures, fittings and equipment on, in or about the Property in a clean and tidy condition. The Guest shall be liable for any extra cleaning, breakages or damage caused to the Property or any part thereof or any of the chattels therein that may occur during the Guest’s occupation of the Property and all costs for extra cleaning, repair and replacement thereof may be payable at the discretion of the manager. Any damage or breakage to any part of the Property or any of the chattels therein shall be reported to the manager as soon as practicable after the damage occurring thereto.
Inventory
Failure to pay in accordance with the agreed terms of payment, may result in suspension of accommodation. Scarlet Woods reserves the right to charge interest on overdue accounts. All damages, additional charges, or cancellations/ no-show fees will be paid for by the guest within 7 days of receiving the invoice from Scarlet Woods. Failure to do so will result in a small claims court claim being filed on the next working day after the deadline. All interest, legal fees and any other charges related to recouping the outstanding debt will be paid for by the guest.
Additional Charges
All our chalets are much-loved, containing personal belongings and household items that we need to protect. Please notify your property manager of any breakages or damage as soon as possible, so repairs can be arranged in time for the next guest. Additional charges may apply at the discretion of the manager. Additional charges may also be charged for instances where extra cleaning is required, over and above the standard cleaning time of the property or a for a breach of these terms and conditions. For example: using the property as a venue for a function, wedding or party, excess noise, or bringing a pet to a non pet-friendly property (which is strictly not allowed).
Charges
The lead booking guest takes full responsibility for any damage or additional charges and accepts that they will be the named person on the invoice and the liability to pay rests solely with them. The lead guest also agrees to settle the invoice within 7 days and accepts that failure to do so will result in interest charged at 8% per day, every day that the invoice remains unsettled, plus any fees incurred to recover the debt. The initial damage will be deducted from any deposit held on file and you give full authorisation for this to happen whilst accepting that anything not recovered by the deposit amount will be paid in full by you, the lead guest, within 7 days of the invoice being issued.
Accommodation
You are only granted a license to occupy the accommodation stated in reservation, and this agreement gives you no other rights, either expressed or implied to the accommodation.
Internet
WiFi is available free in reception and your chalet, passcodes will be provided on arrival. Scarlet Woods will not be responsible for any fault associated with the user's hardware or software and no support will be available, also no compensation in any form will be given for its failure to work.
Hot tubs
Hot tubs are available at Scarlet Woods. The Guest acknowledges that the use of the hot tubs is entirely at the Guest’s risk and neither the manager or owner shall accept any responsibility for any injury, loss or damage to property or any third party arising from the use thereof. Hot tubs are to be used responsibly, no soaps, oils or any other items are to be added (as it causes damage to the filters and pump), also children must be supervised at all times, and when not in use the lid is to be left on.
Noise & Neighbours
We want you to enjoy your stay but please be aware of the impact of your noise on others and keeping your chalet neighbours happy is of paramount importance. Noise and music should not impact any other property and noise levels are to be respectful at all times. There is to be no outdoor music or outdoor entertaining after 10pm. Noise complaints may result in additional charges and possible eviction.
Drones
We strongly discourage the use of drones at our property without prior approval from managers. Should you fly a drone please be respectful of the houses and other chalets and strictly adhere to the relevant flying regulations.
Smoking
Smoking is prohibited inside the chalets, at reception and outside reception. Outside, on the deck it is permitted, there is an ashtray provided. Should you smoke outside, please dispose of butts responsibly in the ashtrays provided and not into the garden due to the risk of fire and obvious littering. Please note; any evidence of smoking or damage in the apartment and hot tub will incur penalties. Such damages will be charged to the guest via invoice payable within 7 working days.
Outdoor Fires
Outdoor fires are only permitted with managers approval, where a firepit is provided, and only during the restricted burning period, in accordance with the specific Shire regulations. If an outdoor firepit is not provided, do not light an outdoor fire. It is your responsibility as the guest to check the Shire website for the Fire Ban Period (usually November to April) before you light any fire of any kind. This includes: Wood fueled BBQs, Wood fired pizza ovens, Chimineas and Outdoor Firepits. If an outdoor fire is evidenced during a Fire Ban Period or where there is not a firepit provided, the fire will be extinguished immediately, you will be asked to leave and you will be issued an additional charge.
Catastrophic Bush Fire
In the event of an upcoming catastrophic bush fire risk day, or a bush fire threat, for your safety, your booking may be cancelled by Scarlet Woods at our discretion, with a full refund or dates changed, whatever is preferred by the guest.
Cleaning
Scarlet Woods expects the property to be left in a reasonable state on departure. If, at Scarlet Woods' discretion, additional cleaning is required on departure, the cost of this cleaning will be an additional charge, again invoiced and payable within 7days. 1 key will be provided, if lost it may occur a small additional charge. Parking is free, there is space in front of the chalet for 2 cars, additional cars will need to be parked further away and can be arranged with the manager of Scarlet Woods.
Pets
Scarlet Woods does not allow pets on site. If found, additional charges will be applied and you may be asked to leave.
Liability
All personal belongings, baggage, vehicles and other property of the Guest of any description shall be the risk of the Guest at all times and the manager or owner does not accept any responsibility for any loss or damage thereto. Scarlet Woods cannot be held responsible in any way for loss of or damage to, contents, furniture, fittings, or any personal belongings at the apartment locations. Nor can Scarlet Woods be held liable for the acts or defaults caused by third parties. You are advised to ensure your own insurance policies cover loss and damage to personal property during your stay. Guests are advised to take out adequate travel and personal insurance. Nothing in this contract seeks to exclude liability for death and personal injury.
Lost Property
Personal belongings left at a property can be returned to a nominated address, a postage & handling fee of $50.00 will be charged to your credit card. If our guest services team find lost property at a holiday home, we will hold the items for a maximum of one month.
Access to Properties
In addition to the weekly housekeeping service, Scarlet Woods staff may on occasion require access to the chalet in which you are staying. Scarlet Woods staff have the right to gain access to all the chalets at all times. We will, whenever possible, endeavour to give guests as much notice as possible prior to entering the apartment.
Services
Scarlet Woods cannot be held responsible for any failure or interruption of services to the property, including electricity, water, internet or any damage, disruption or noise caused as a result of repair works being carried out.
Communication
Scarlet Woods managers live on site, generally available 8am-6pm, but contactable for emergencies any time out of this period. 0473831364. Check in is available any time after 2pm, but may be self-check in if staff are occupied elsewhere or it is late.
Availability of Property
The short-term accommodation contract negotiated by Scarlet Woods between them and the Guest is made on the understanding that the Property and its facilities as stated in the booking confirmation will be available as represented to the Guest. Should any events whatsoever arise beyond the reasonable control, which render the Property uninhabitable (for example flood, fire, storm, tempest, etc), then Scarlet Woods may have to cancel the Guest’s booking for the Property. Should such circumstances arise then Scarlet Woods will endeavour to relocate the Guest to a holiday home of a similar standard to the property in the same area. Where this is not possible, Scarlet Woods will refund all monies paid by the Guest in respect of the Property.
Representations
The Guest acknowledges that Scarlet Woods has used its best endeavours to describe the Property to the Guest within the limited extent of the communications between the Guest and Scarlet Woods, and Scarlet Woods shall not be liable to the Guest in any respect should the Guest consider the Property to be unsuitable for any reason whatsoever.
Description of the Property
All information in respect of the Property contained in Scarlet Woods website is believed to be correct at the time of the publication, however, all details are subject to change by Scarlet Woods without notice. Scarlet Woods will not accept any responsibility for any alterations to the Property, or any liability for any matter or occurrences beyond our reasonable control including damage caused by extreme weather conditions, break down of appliances, wiring, plumbing, invasion of pests, or any act causing loss, accident or injury to the Guest or any one or more of them.
Entire Agreement
This agreement shall be governed by the laws of the Manjimup Shire, Western Australia and Australia, and the Parties submit to the exclusive jurisdiction of the Australian courts and the Rental Agreement between the parties relating to the subject matter of the Agreement supersedes all previous communications, agreements or other arrangements written or oral. It expressly agrees that no variation of this Agreement shall be effective unless in writing and signed by a duly authorised signatory of both parties.
